The spreadsheet is totally sorted now according to the PD. I had to make one change though. The day of the month of PD was not mentioned and I had to write something to sort it out. I made it 1st of the month for everybody to be able to so sorting. You can change the day if you want to. Also please do not sort the data yourself. I will do it periodically. Just enter your info at the end.

I was looking for getting VISA for my Niece and Nephew, who are below 14yrs. But I didnt find an option for them not going to consulate.
it take more effort n paperwork to get the visa without going to consulate even for the kids below 14, better option is to go to consulate.
My 4 yr old niece went in person for the visa along with an adult of course.

Thanks for all your suggestions guys.
Looks like I can not file the new one in EB2 as long as I'm with the current employer as the masters degree completed after joining the current employer. I would have to look for a different employer in case I need to file a new one again.

You should be fine. Not only you filed your extension on time (so the approval should apply retroactively, more likely that's the USCIS mistake), but two law provisions protect you:
1) 8 C.F.R. section 274A.12(b)(20) - An H1B holder whose employer has filed a new H1B petition to extend the stay (through the current employer - NOT a job change) can work for up to 240 days based upon the pending H1B petition;
2) 8 U.S.C. 1255(k) allows you to adjust status even if you worked without authorization for not more than 180 days.
Oh, yes, I've had a similar RFE for my dependants to show continuous H4 status so it's not unusual.

I had similar situation where on H1B he was showing different salary...but he was paying less..difference is almost $10000 per year...it is between Aug 2003 and Oct 2004...Can we do anything now?

I am a July 2 filer. I got 485 receipt notice from California Service Center with receipt date of july 2. Today, in mail, I got another notice called transfer notice, which states that my case has been transferred to Nebraska. The receipt date on the transfer notice is Sep 5. Is it nromal to have such diferent receipt dates? Will USCIS process by receipt date on receipt notice or on transfer notice?

I saw that priority date for EB2 (all other countries) now is current, while for EB3 is May 2005.....
Does it mean that when my LC is ready I will have to wait my priority date for approximately 3 years?

How does one go about canceling the pending EB2-NIW i-485 (possibly get the money back... will be glad to donate it all to IV :D:D)

Just a small glitch in your case.. when USCIS approves a case it automatically rejects any other pending application for 485.. infact it is a prerequisite for the AO to check this before the application can be approved. Surprised that in your case it did not happen.
BTW you did mention that your dependents got approved on your EB2 application and your got on EB1.. seems like USCIS went out of the way to accommodate and change the process in your case...well seems like you might end up getting naturalized in another month of so.. Lucky you...

Be careful about claiming residency thru employment for a Canadian company while outside the country. It is not automatically considered. I had the first hand experience myself while applying for Canadian citizenship. I was a few days short, however was able to prove my case because I was employed by a Canadian company which was doing business in the US and I was a frequent business visitor. I was approved because of all other things considered, time spent in Canada, family ties, owner of residential property in Canada etc. etc. But overall it wasn't a pleasant experience proving my case to CIC. I had to organize tons of paperwork and proof to prove my case. So just don't assume you will meet the requirements of residency with only a remote employment connection with a Canadian entity.

EB1-EA requires "extrodinary ability". So you need to have national/international merit/awards like olympic medal or nobal prize. Just having PhD and having tons of papers will not necessarly makes a person as "extrodinary". So it is tricky and diffult. It is better to consult a any of your friend, if they got through EB1-EA, or otherwise consult a good lawyer who is capable of making sucsesful EA cases. This forum mainly thros idea on Eb2/EB3 and retrogression issues. You may not find a good answer here.

My F1 grace period is almost ending. I filed the change of status application to take H4 status and I have received the receipt for it. It says it takes about 100-150 days for the decision. My employer is going to apply for my H1B on April 1, 2006 and I think I will not have the H4 approval by then. Is it possible to apply for H1B with this pending H4 situation? I am concerned since my F1 grace period will end in a week. Will there be any problem at all?

The information quoted by morpheus is quite correct. you can attend board meetings as a director although honorory or because of your extensive shareholding. you cannot be a salaried, contracted or basically compensated director or board member. you cannot take salaries but can take dividends (profit). you can also apply for any licenses or authorizations required for the business in your name. just make sure you dont write anything off in your name to save the taxes on the dividends because that will show your active involvement (day to day) which you cannot have.
I owned business and had state and federal licenses when I was on F-1.
And very frankly if you have any innovative ideas are an entrepreneur immigration and visa is the last thing you should worry about. There are many ways to to that and if you have a trustworthy citizen or GC holder as a partner it is very easy. just concentrate on your ideas and plans. contact a lawyer, do some reading of IRS pubs, and immigration law.

Once you become active, you need an employment visa e.g. H1 to cover that. Since moving to the US I have owned and/or founded a couple of companies. I filed a visa so I could actively manage one of them. The others I am just a passive investor. One interesting question is can you attend a board meeting and still be a passive investor? Personally I think so, because board membership is not employment. Some may prefer to err on the conservative side.
Income from activites like Google Adsense or royalties is a grey area. It would make an interesting case, because it's very hard for the USCIS to say it is 'employment' rather than passive income. Any legal advice in this area is just an opinion. According to my attorney, there are no USCIS memoranda or case law on the subject.

DOS & USCIS will have all data entered into their systems once they receipt all these 320k cases. Using past USCIS processing speed as another input, DOS should be able to issue accurate EB cut-off dates in all categories.
One can only really hope that they do this more accurately atleast by next bulletin & move forward cut-off dates.
In absence of any legislative changes so far, the EB community should really push for processing efficiencies more. (So far looks like atleast no visa numbers were wasted in FY 2007)

I have a h1B and a EAD. I was laid off one week back. Will there will be a problem if i take 6 months vacation, get a master degree, Try doing a business. Do i need to immediately find a job. I will be getting unemployment benifits and i think my H1B won't be valid since i lost my job and my next job would be on EAD.
Any suggestions, I am waiting for an answer from my attorney too.
