i have not applied for a GC as yet.
I want to buy a franchise and start my own business.
later on I want to apply for my GC.
How did you manage to pull this one off ? you got an EAD without applying for GC ?!!

Six years in US complete
I-140 approved
Not able to file I-485 because of retrogression
Wife not able to work
Moving around for jobs with family
Cheating Employer
Frustation with H1B Extension and stamping
Not able to Plan to go to India because of Interview dates
Not able to plan on good school Child's education
Not able to spend more money on good health insurance
Lot of money spent on H1B Extension and stamping
Sick with the current employer
Don't want my employer to take lot of money in between. Can we switch employer and file a new H1B with new employer.
Do you guys think the retrogression will end soon? frustration everyday.

In addition to what the attorney wrote, PERM appeals take forever. So the best would be to re-apply for a new PERM.

Not to question you or something, my understanding is that, you can file a 7th year extn based on I-140 .. Has the rule changed?
File an H-1B extension while the PERM appeal is pending, asking for one year extension beyond the 6th year. It will be approved with proof of the pending appeal. Then, file a prepare a new PERM filing, withdraw the appeal, and file the new PERM case. With LUCK, you will be able to get the PERM approved and Premium Processed the I-140 before the termination of the 7th year H-1B.

Well said EB3 retro!! I like you approach. I have lost interest of GC. And actually, I don't care at all what happens to GC as I don't want to make my life decisions based on USCIS guidelines. I mean, I came here 11 years ago and I think US has lost the efficiencies it was known for. Very sad, but true.

Now I have a question?
My H1 is valid till May 2010 but not stamped. I have AP with me. If I go to India and come back on AP, I will still be on H1 and can even extend beyond 2010. If this is valid, then I think I do not have to get my visa stamped. That will be cool.
I am also planning to do that. I think we can do that but I will clarify with my attorney next week.

This is from reading in other threads here, if you switch to EAD and give up your H1 status you can no longer go back to the same H1 petition. You will have to apply for H1 again and then be part of the H1 lottery. Again this is my understanding I am not a lawyer.

The research for this was conducted by the content team of IV. And as regards the big websites, Rajeev Khanna, Bender's online Matthew Oh all have provided references to IV's doc. Is there any possibilty for amendment from any senatore in floor discussion? Please post the procedings in this issue, as I feel this may be ignored by senaters due to the controversial guest worker program.
By the way is there any differnce between 202a3 and 202a5?

I have a valid H1 till 2012. As my company was going lean during the recession they asked me to work in India (no office in India - was working at home) for 1 year. Now they want me back in US. I am planning to get back in Feb 2010. I was not on payroll for 2009. My company transferred an amount every month to my indian bank account. My questions -
1. At the Point of Entry (POE) will they ask me why i was out of US for 1 year? - what should i tell them - will "health reasons" work?
3. Will they ask for payroll or W2 for 2009?
2. Will they ask me any sort of documents - other than I797?
Heard that POE's at Washington, Chicago are pretty strict - can someone please suggest a POE that i should choose.

Actually, there is a stamp in the passport at the time of entry to US (Dec 2007). And they can verify that. That's why we entered Dec 2007 as the last entry date in I-485 form. It's just that I-94 has the old date (Feb 2005). We're hoping this won't cause any trouble during the interview.

The way I see it....You have an I797 approval till 2010. Once you have that, it does not matter on what basis it was received. The I797 approval does not say "Only valid until I140 has not been withdrawn" etc.
