Hello,
My wife got her H1B approved last year and her start date was 10/01/07. She started working towards the end of Nov. She did not get any paychecks for 2007 before Dec 31st and started getting paid only in 2008. So she did not receive a W2 for 2007. I am about to file my tax for 2007 (had filed an extension) and would like to know the following.
1: I assume this should not impact me from filing a joint return. Am I right ?
2: Would I qualify for the stimulus check for $1200 since both of us were employed in 2007 ? Since she did not get a W2, I was not sure if I would get only $600.
3: Both of us have filed for I-485 and our applications are pending approval. Would there be any problem with her I-485 in the future (like any query) since in 2007, her status was converted to H1B (from H4) and she did not get a W2 ? I am being told USCIS does a complete background check on the applicant with respect to each status he/she has had.

For point # 3 you can always tell USCIS that she joined the company in Nov 2007. It is not required to join the co. on Oct 1 although one gets converted to h1b from h4 when you change status in US. There is something like late joining also hence no pay !
Obviously the employer should have paid her but if she is working thru a desi firm I would understand what would be the case......
I do not think this will impact your 485 as long as you have pay chqs. coming for her in continuation thereafter and w-2 for 2008 meets the Amount on h1b LCA. USCIS will generally look for w-2 and might ask for recent pay stubs.
I have been interviewed for 485 (random pick) and they did not care to look at my pay stub even when I asked them to.........
Ensure that w-2 has the correct numbers else it can be trouble.
Consult a lawyer as all the above is my experience and limited knowledge.......

Thanks all for your kind assistance.
After consulting with another owner of a D-100 (which I accidently met on the street) it seems that the problem is indeed power source related.
I do a six normal batteries and when I replaced it all went well.
One more thing.
Do u guys know a 4gb memory cerd (Hitachi's). The camera display is different when I use this card and an original (much smaller) one.
When using the 4gb card I can't see the number of photos left. Is this normal?
Is the card infected with some virus? Or maybe I received some cheap used card ?

When our original APs arrived last year in October they had a expiration date of September 28, 2008. But then we traveled to India and came back on AP. Now stamped AP says

My question is which expiration date should use for renewal purposes and apply the 120 day rule.

Eligible for 3 years if I140 is approved and you can't file I485 because of retrogression. But you said , you had already filed I485. I doubt you are eligible for 3 year extension.
thats not how USCIS interprets this (see the FAQ they released recently). They will give you a 3 year extension if 485 cannot be APPROVED because PD is not current, not only in the case where 485 cannot be FILED.
The wording of AC21 is a bit vague (3 year extension eligibility once 485 is filed) but USCIS interpretation has been clear until now in what they have been doing, and with the FAQ they even put it in print!

Inspite of telling my lawyer she did the mistake of sending my EAD and AP before 120 day period. EAD filed 121 days prior and AP filed 148 days prior. I have gotten the receipts of both but AP status says that they have requested more information/evidence. I am wondering what additional information they need. Anyone else in this situation ?

I am in the same boat and need to get my address updated. So what I understand from above posts is that there is no need to do paper based AR11 and can just do it online for I-485, EAD as well as AP, right?? Once done, just keep printouts for records , thats it???

You can amend the same petition. Tell your company to contact a lawyer to do that. They need to pay $200 fee and lawyer fee. May be needed new LCA for latest salary requirement. With the amended approval, you can stamp for the visa.
You can say studies (advanced) or sick (family or you ) as the reasons for not take up the position.

Apparently the job offer on which the visa was applied in 2007 dried out in 2008 and can that be stated or would the embassy question if the job offer was not a stable one , why did one apply for the visa ?

How about pledging anywhere between 1 to 5 % of our tax returns? If enough people do it, that should do the trick.. But we need to widen the base, I think.. I don't think the problem is of people not contributing enough, the real problem is that we do not have enough people contributing.

Certainly a vast majority of them are in the US with the intent to immigrate in the long term. If they spend the same amount of money for comparable education in Canada, Europe or Australia, they will never face the lousy and frustrating US immigration situation!
